Recently in the Supreme Court the legal principle of Testamentary Freedom was upheld in a contested case, which is very good news. This was largely due to the Will Writer and other witnesses having solid evidence of the deceased mental capacity at the time of writing the Will.

Private consultations in the comfort of your home can be arranged either face to face or by telephone if more convenient.  Prefer a coffee and chat ? Meetings can easily be booked in advance at a local venue.

What steps are require to create a Simply Spanish Will?

First step is to contact us!

  • We answer any questions you may have
  • A Consultation is arranged in the comfort of your own Home, at a local venue, at a Hospital or by Telephone Call or Zoom. Please allow one hour for our meeting.
  • Comprehensive notes taken at the Consultation detailing all of your wishes will be formatted and sent to you for approval together with an invoice for our service's.
  • Once instructed and payment is received we arrange appointment at the Notary for your Bilingual Will written in both English and Spanish to be notarised. (Notary Fees are paid direct )
  • The date will depend on the Notaries availability and of course yours too.
  • We like to attend the Notary with you!
  • If you are overseas, we will arrange it for when you arrive in Spain 
  • For our clients in Palliative Care we can arrange for a Notary to visit you. (The Notary  may charge extra but we will get a quote )
  • Once the document is notarised you will be given a hard copy of the Will and an email copy will be sent to you. The Notary will keep their own copy.  After which the Will is sent to the Central Registry in Madrid part of the Ministry of Justice.  It is a Closed document which means nothing can be added or removed. It is stored securely and can only be accessed by those acting in a legal capacity. If you wish to make changes a completely new will has to be arranged and notarised.

Please note: you will need to take your ID as above to the Notary appointment.
