  •  Notary have their own fees to notarise documents so you just pay them for that on the day. You get the original document with the notarial seal for you to store and the Notary keeps one as well, so if anything pops up later its easy to retrieve.

Succession Law's all over the shop, varies loads from one country to another. New E.U. legislation known as Brussels IV / ruling EU 650/2012 gave expatriates in Spain something very important... the right to choose. The choice to make a will using the Law of their own Nationality. Your will is prepared using the law of England and Wales. Also Republic of Ireland and Scotland. 

🚫"For those who pop their clogs without a Will in Spain" - basically, if you haven't sorted a will, things get messy, and the law steps in. Interferes with beneficiaries, ignores your partner, favours family you ain't spoken too in years and it will be a proper long slog to sort out for your loved ones. Not something you will want and if no heirs found then the Government could take the lot.

Recently in the Supreme Court the legal principle of Testamentary Freedom was upheld in a contested case, which is very good news. This was largely due to the Will Writer and other witnesses having solid evidence of the deceased mental capacity at the time of writing the Will. in meeting the Testator face to face the Will Preparer may conduct his or her own screening of the persons current health and ability to make decisions. It is important to make a Will before any medical procedure which could affect temporarily or permanently your mental capacity.
